General Terms and Conditions
1. Range of services
IN LAIN Hotel Cadonau AG will always proceed with care when executing orders. Our goal is to optimally combine professional expertise with personalized service. We understand professionalism as the ability to comprehensively and sustainably fulfill customer requests with high standards. With our services and products, we aim to exceed these high standards as a rule, but at least meet them. Excellent cuisine, first-class service, and warm hospitality are equally important and go hand in hand. When selecting food and beverages, we place great emphasis on impeccable quality.
2. Conclusion of contract
Upon receipt of the written, telephone, electronic, or personal booking and delivery of our confirmation, a contract between the guest and IN LAIN Hotel Cadonau AG is concluded. These general terms and conditions are an integral part of this contract. Communications by email are considered to be in writing. Any services beyond the scope of the order confirmation will also be invoiced. These general terms and conditions apply to all legal relationships between the guest and IN LAIN Hotel Cadonau AG.
3. Offers
As a rule, an initial general quote is provided free of charge. If the customer requests a detailed quote and a contract is not subsequently concluded, IN LAIN Hotel Cadonau AG is entitled to charge for its efforts in connection with the preparation of further quotes in accordance with the time and expense involved. Any trial meals requested by the customer for any reason will be charged separately. Cancellations of binding reservations and table reservations are subject to a fee.
4. Minor changes
IN LAIN Hotel Cadonau AG reserves the right to make minor changes to its delivery services in the event of short-term changes in market supply due to a lack of goods or massive price increases. In doing so, it will take the customer's interests into particular consideration and offer an equivalent order fulfillment.
5. Booking conditions
For all bookings not made via the Internet, the confirmation form sent by us must be signed and credit card details provided as a guarantee. If these conditions are not met, IN LAIN Hotel Cadonau AG may cancel the booking without notice. Section 8 below applies to cancellation fees.
6. Payments
All prices are quoted in Swiss francs and include local taxes and statutory value added tax.
IN LAIN Hotel Cadonau AG charges payments on account. Normally, 1/3 is payable upon placing the order and 1/3 before the start of the event. The remaining payments, including any additional services, are made after the end of the event with a detailed invoice.
A reduced number of guests that is not reported at least 7 days before the event can no longer be taken into account in the invoice. If the order is revoked by the customer after it has been placed, IN LAIN Hotel Cadonau AG shall be held fully harmless. In such a case, IN LAIN Hotel Cadonau AG's claim for compensation shall be calculated according to the circumstances, but shall be at least one third of the amount stated in the order confirmation.
Unjustified cash discounts will be charged retrospectively. The costs incurred for such retrospective charges will be invoiced. For payments not made in accordance with the contract, default interest of 6% will be charged on the amount due for payment.
7. Price changes
IN LAIN Hotel Cadonau AG may change the advertised prices in the following cases:
- Newly introduced or increased government taxes (e.g., value added tax, visitor's tax, etc.)
- Exchange rate changes (converted according to the daily exchange rate of IN LAIN Hotel Cadonau AG)
- Clearly explainable printing errors
8. Cancellations and rebookings for room and banquet reservations
General Terms and Conditions
If a guest makes use of orders or reservations later than agreed, or not at all, or if they cancel them prematurely, IN LAIN Hotel Cadonau AG is entitled to compensation in accordance with OR 97ff and 264. Cancellations or rebookings are only valid if they are sent in writing to IN LAIN Hotel Cadonau AG. The following costs will be incurred:
8.1 Package and hotel bookings for individuals
- Changes/cancellations up to 14 days before arrival: any deposit already paid will be refunded in the form of a voucher.
- Changes/cancellations from 14 to 7 days before arrival: 50% of the booked arrangement.
- Changes/cancellations from 6 days up to and including 0 days before arrival: 100% of the booked arrangement.
- Reservations at the VIVANDA gourmet restaurant that are not canceled at least 48 hours before arrival
will be charged at CHF 200.00 per person. Cancellations on the day of reservation will be charged at CHF 250.00 - Reservations at the à la carte restaurant La Stüvetta that are not canceled at least 24 hours before arrival
will be charged at 100.00 per person.
8.2 Package and hotel bookings Events and banquets
Cancellation fees for room reservations for events:
- Changes/cancellations up to 90 days prior to arrival: Free cancellation possible. Any deposits already paid will be refunded in the form of credit notes.
- Changes/cancellations between 89 and 60 days prior to arrival: 40% of the booked arrangement.
- Changes/cancellations from 59 to 30 days prior to arrival: 60% of the booked arrangement.
- Changes/cancellations from 29 to 0 days prior to arrival: 100% of the booked arrangement.
Cancellation fees for banquets:
- Changes/cancellations up to 90 days prior to arrival: Cancellation free of charge. Any deposits already paid will be refunded by credit note.
- Changes/cancellations from 89 to 60 days prior to arrival: 20% of the booked arrangement.
- Changes/cancellations from 59 to 30 days prior to arrival: 45% of the booked arrangement.
- Changes/cancellations from 29 to 8 days prior to arrival: 90% of the booked arrangement.
- Changes/cancellations from 7 to 0 days before arrival: 100% of the booked arrangement.
The arrangement is understood to be the menu price multiplied by the number of guests specified in the reservation confirmation. If no menu has been specified, this will be charged at CHF 150 per guest.
8.3 Cancellation date and insurance
The date of cancellation is determined by the date on which the written declaration is received by the booking office. On Saturdays, Sundays, and public holidays, the next working day is decisive. In cases of hardship, the cancellation costs will be covered by cancellation insurance, provided that the guest has taken out such insurance.
8.4 Providing a replacement
If the booked package or individual booking cannot be taken up, IN LAIN Hotel Cadonau AG will accept a replacement person who must take over the existing booking under the same conditions. The replacement person must be notified to IN LAIN Hotel Cadonau AG in good time (before arrival). The original guest remains the contractual partner and is liable to IN LAIN Hotel Cadonau AG.
9. Disruptions and operational restrictions
Disturbances such as noise and/or operational restrictions do not entitle guests to compensation or reimbursement.
10. Liability for damages and responsibility
IN LAIN Hotel Cadonau AG shall only be liable for damages in cases of intent or gross negligence. Liability for guests' belongings is excluded to the extent permitted by law. Claims must be submitted in writing to IN LAIN Hotel Cadonau AG immediately, at the latest 7 days after departure; otherwise, the claims shall be deemed forfeited.
IN LAIN Hotel Cadonau AG further rejects any liability for theft by guests and third parties.
11. Use of hotel rooms
The hotel room must be used and treated with the utmost care by the guest. It may only be used or occupied by the number of persons (including children) specified in the contract. The guest is not permitted to allow third parties to use the hotel rooms rented from IN LAIN Hotel Cadonau AG (except for replacement persons in accordance with section 8.3 above) . The guest is liable for any damage unless they can prove that it was caused through no fault of their own (or that of other users). Damage must be reported to IN LAIN Hotel Cadonau AG immediately.
12. Pets
Pets are permitted at the IN LAIN Hotel Cadonau upon prior notification and in certain areas of the hotel.
13. Damage during events
The guest or the client organizing the event is primarily liable for any direct or indirect damage to the building (exterior and interior) and the entire hotel grounds, even if such damage was caused by the event organizer hired by the guest. The guest is also liable for any actions that violate the contract or are negligent. For larger events, IN LAIN Hotel Cadonau AG may draw up an entry report and a return report together with the guest or the responsible organizer so that any damage caused during the event can be determined. The amount of compensation is limited to the costs of repairing the damage and will be charged in full to the guest by IN LAIN Hotel Cadonau AG.
14. Data protection
IN LAIN Hotel Cadonau AG undertakes to comply with the applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data will only be used to maximize operational security or in the interests of sales promotion, product design, crime prevention, the collection of key economic data and statistics, and invoicing.
The guest hereby acknowledges and agrees that IN LAIN Hotel Cadonau AG is entitled, in cases of joint provision of services in cooperation with third parties, to make customer data available to the third parties concerned to the extent necessary in the interests of providing the services. Otherwise, the transfer of customer data to third parties is only permitted with the express consent of the customer. 15. Applicable law and place of jurisdiction
Swiss law applies exclusively to all contracts concluded with IN LAIN Hotel Cadonau under these General Terms and Conditions. The exclusive place of jurisdiction for any disputes arising from such contracts is Zernez.
